Tornium Terms of Service

These Terms of Service (”Terms”) describe our commitments to you, and your rights and responsibilities when using our Services. Please read them carefully and reach out to us if you have any questions. If you don’t agree to these Terms, don’t use our Services.

If you access or use the Service, you agree to and are bound to the below terms and all applicable laws and regulations. You are also responsible for informing users in your Discord server(s) about these Terms. There may be times where we do not exercise or enforce a right or provision of the Terms; however, that does not mean we are waiving that right or provision. These Terms do contain a limitation of our liability. If you do not agree to these Terms, you must not access or use our website, bot, or other Services.

Changes to these Terms

We reserve the right to modify these Terms at any time. Unless explicitly stated, any new features which are added to the Service shall also be subject to the Terms. Whenever we make changes to these Terms, the changes are effective 30 days after we post such revised Terms (indicated by revising the date at the top of these Terms). It is your responsibility to check Tornium for changes to these Terms. If you continue to use the Service after the revised Terms go into effect, then you have accepted the changes to these Terms.

Third-Party Services

From time to time, we may provide you with links to third party websites or services that we do not own or control. Your use of the Service may also include the use of applications that are developed or owned by a third party. Your use of such third party applications, websites, and services is governed by that party's own terms of service or privacy policies. We encourage you to read the terms and conditions and privacy policy of any third party application, website, or service that you visit or use.

We use third party vendors and hosting partners to provide the necessary hardware, software, and related technology required to run the Services. These third party vendors and hosting partners include but are not limited to Datadog, Torn City, Hetzner, and TornStats.

Account Terms

- You must be at least 13 years old to use the Service.

- You are responsible for the security of your API key(s) and for any use of your account. You must notify us of any unauthorized access or use of your account or API key(s). We can not be held liable for any loss or damage resulting from your failure to protect your account information. We recommend all users set up two-factor authentication for added security.

Use of Service

- Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis. We do not offer service-level agreements for any of our Services.

- Your use of the Service must comply with all applicable laws, regulations, and ordinances.

- You agree not to engage in any activity that interferes with or disrupts the Service or attempt to interfere with or disrupt the Service.

- You agree to only access and use your account and API key(s). You agree to not access, attempt to access, or use another user's account or API key(s). Any such activity will be considered a violation of these Terms and may result in immediate suspension or termination of your access to the Service.

- We reserve the right to enforce quotas or usage limits to any resource at our discretion, with or without notice.

- We reserve the right to terminate your access to the Service at any time, without notice, for any reason.

- You agree to not post, link, or otherwise make available on or through the Service any of the following:

  • Content that is libelous, defamatory, bigoted, fraudulent or deceptive;
  • Content that is illegal or unlawful, that would otherwise create liability;
  • Content that may infringe or violate any patent, trademark, trade secret, copyright, right of privacy, right of publicity or other intellectual or other right of any party;
  • Mass or repeated promotions, political campaigning or commercial messages directed at users who do not follow you (SPAM);
  • Private information of any third party (e.g., addresses, phone numbers, email addresses, Social Security numbers and credit card numbers); and
  • Viruses, corrupted data or other harmful, disruptive or destructive files or code.

- You agree to not use automated scripts, scraping tools, bots, or any other form of non-API programmatic access to the Service. All automated interactions with the Service must occur exclusively through our provided API and in compliance with these Terms. Any attempt to bypass the API, extract data directly from the website, or otherwise interact with the Service in an unauthorized programmatic manner is strictly prohibited and may result in immediate suspension or termination of your access to the Service.

Features and Bugs

We design our Services with care, based on our own experience and the experiences of customers who share their time and feedback. However, there is no such thing as a service that pleases everybody. We make no guarantees that our Services will meet your specific requirements or expectations.

We also test all of our features extensively before shipping them. As with any software, our Services inevitably have some bugs. We track the bugs reported to us and work through priority ones, especially any related to security or privacy. Not all reported bugs will get fixed and we don’t guarantee completely error-free Services.

You may choose to or we may invite you to submit comments or ideas about the Service, including but not limited to ideas about improving the Service or products. By submitting any idea, you irrevocably assign to us all of your right, title and interest in and to your feedback, comments and suggestions.

Services Adaptations and API Terms

We offer Application Program Interfaces (“API”s) for some of our Services. Any use of the API, including through a third-party product that accesses the Services, is bound by these Terms plus the following specific terms:

  • You expressly understand and agree that we are not liable for any damages or losses resulting from your use of the API or third-party products that access data via the API.
  • You may be required to obtain an API key, OAuth credentials, or other authorization to use the API. You are responsible for maintaining the security of these credentials and for all activities that occur using them.
  • Abuse or excessively frequent requests to the Services via the API may result in the temporary or permanent suspension of your account. We, at our sole discretion, will determine abuse or excessive usage of the API. If we need to suspend your account, we will attempt to warn the account owner first. If your API usage could or has caused downtime, we may cut off access without prior notice.
  • We reserve the right to modify, discontinue, or revoke API access at any time, with or without notice. Continued use of the API following changes constitutes acceptance of those changes.
  • API clients MUST provide a publicly accessible, accurate privacy policy that clearly describes:
    • The categories of data retrieved from the API by the client;
    • The purposes for which the data is used by the client;
    • The duration for which the data is retained by the client;
    • The process by which users can request deletion of their data from the client;
    • The circumstances under which that data is shared, disclosed, or transferred to any third parties, and the reasons for such sharing.
  • API clients MUST request only the minimum OAuth scopes required for the functions of the client. The clients MUST not use or retain data for any purposes beyond those explicitly consented to by the user.
Some third-party providers may have created integrations between our Services and theirs. We are not liable or accountable for any of these third-party integrations.

Ownership of Material and Software

The materials and software provided through this Service is licensed under the GNU General Public License version 3 (GPLv3). You can view the full text of the GPLv3 license on GitHub. As required by the GPLv3 license, the source code for the software is available on GitHub.

Liability

You expressly understand and agree that Tornium shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to these Terms or the Services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
